In Alberta, the Marriage Act does not recognize same sex marriage; however, this legislation is overridden by the federal Civil Marriage Act. Pursuant to the federal Civil Marriage Act, which received Royal Assent in July of 2005, same-sex marriage is permitted in Alberta and across Canada.

Section one of the Civil Marriage Act defines Marriage as:

… for civil reasons the lawful union of two persons to the exclusion of all others.

The laws surrounding marriage, common law and adult interdependent relationships are the same for heterosexual couples as they are for same sex partners.
