In Alberta, the Marriage Act does not recognize same sex marriage; however, this legislation is overridden by the federal Civil Marriage Act. Pursuant to the federal Civil Marriage Act, which received Royal Assent in July of 2005, same-sex marriage is permitted in Alberta and across Canada.
Section one of the Civil Marriage Act defines Marriage as:
… for civil reasons the lawful union of two persons to the exclusion of all others.
